FACTS: Trial of JWW, he was accused of 5 counts relating to sexual assault. JWW provided childcare for the 8-year-old complainant. The accused denied the allegations of the complainant. The complainant had recognizable symptoms of
FASD, but the mother denied consuming alcohol during pregnancy. The accused stated that the complainant was defiant; this was confirmed by other people who were in contact with the child.
HELD: JWW was found guilty. Guilty verdict entered. The complainant's allegations were confirmed with evidence. The complainant's behavioural issues did not raise reasonable doubt.
