FACTS: CMS was convicted of sexual assault. His victim had recognizable symptoms of Glossary Link FASD.

HELD: CMS was sentenced to a 3-year custodial sentence. The victim impact statement was included in the pre-sentence report because she didn't have the abilities without help to adequately describe the impact the assault had on her. The social worker's opinions were deleted.
