R. v. J.W.W. [2001] S.J. No. 811

FACTS: Trial of JWW. He was accused of 5 counts relating to sexual assault. JWW provided child care for the 8-year-old complainant. The accused denied the allegations of the complainant. The complainant was found to have recognizable symptoms of Glossary Link FASD, but the mother denied alcohol consumption during pregnancy. The accused stated that the complainant was defiant; this was confirmed by other people who were in contact with the child.

HELD: JWW was found guilty. The complainants allegations were confirmed with evidence. The complainant's behavioural issues did not raise reasonable doubt.
