R. v. PP [2001] O.J. No. 5671

FACTS: Charged with sexual interference, PP pleaded guilty. PP was a friend of the SG family. SG suffered from Fetal Alcohol Syndrome, was developmentally challenged and had the intellectual capacity of an eight year old. SG was a child when the oral and anal sexual interference took place, and considered suicide because of the incidents.

HELD: PP received a 20-month sentence to be served in the community in addition to 3 years probation. The aggravating factors included the trust relationship PP had with SG who was diagnosed with Glossary Link FAS and the negative impact it had on SG. The mitigating factors were PP's guilty plea and his willingness to participate in treatment. Further, by entering a guilty plea, SG was not burdened with having to provide testimony in court.
