R v W.A.L.D. [2] [2002] S.J. No. 222

FACTS: Application by WALD 2 to determine whether he was fit to stand trial. He was charged with 7 breach related charges and one theft related. He and his twin brother (WALD 1) had been diagnosed with Fetal Alcohol Syndrome.

HELD: Application granted, WALD 2 was not fit to stand trial. Expert evidence had proven that WALD did not understand the court process and would not be able to assist in his own defence. He would not be able to appreciate the consequences of a guilty plea.
