FACTS: Application by WALD 1 to determine whether he was fit to stand trial. He was charged with 3 theft-related charges, an assault, and breach of undertaking. He and his twin brother (WALD 2) had been diagnosed with Fetal Alcohol Syndrome.

HELD: Application granted. WALD 1 was not fit to stand trial. Expert evidence had proven that WALD did not understand the court process and would not be able to assist in his own defence.
