FACTS: In 1999, the accused was apprehended and charged with attempted robbery of a store and its customers. During the trial, Dr. C.A. Loock and Dr. J. Conry conducted an assessment of C.J.M.'s psychological condition and presented their results. They concluded that the defendant most likely suffered from
FAS, but since confirmation of maternal alcohol consumption could not be obtained, a diagnosis of partial FAS was advanced.
HELD: In light of the diagnosis and the special needs entailed, typical incarceration facilities were deemed unsafe and inappropriate. Accordingly, C.J.M. was sentenced to serve two years in community custody, followed by a probation order.
