FACTS: Application by RF for a determination that she was not criminally responsible due to mental disorder. Experts had diagnosed RF with partial Fetal Alcohol Syndrome ( Glossary Link pFAS). She was accused of 18 offences including breaches, obstruction, weapons, and property offences. She understood that there were consequences if she had broke the law.

HELD: Application dismissed. RF was unable to prove that she was not criminally responsible due to mental disorder. RF had a mental disorder meeting the first part of the test. However, RF did not establish that she was not aware her actions were wrong. RF's mental disorder was not so severe that she could not understand that her actions were wrong. However, her disability would be considered at later hearings if applicable.
