FACTS:  The objective of this hearing was to settle a disagreement between the Defence and the Crown regarding the sentence of the accused, an individual previously dubbed a dangerous offender. The Crown requested incarceration of indeterminate length, whereas the Defence argued for a determinate period of imprisonment. Loyns was incarcerated for sexual assault and had a lengthy criminal record of sexual molestation. Furthermore, Loyns had shown no improvement despite participating in several rehabilitation programs designed for sexual offenders.  Dr Semra testified the Loyns' Glossary Link FAS-related deficiencies contributed to the lack of progress in treatment.

HELD: Considering Loyns' dismal prospects for rehabilitation, the court sentenced him to be incarcerated for an indeterminate length of time.
