YUKON TERRITORY - Territorial Court: T.L.R.B. (Re) [1995] Y.J. No. 94

FACTS: The Director submitted an application requesting the permanent care of T.  The father opposed the application.  Although the child was diagnosed as suffering from FAS, the disorder was not considered to be a mitigating factor. 

HELD:  The father was deemed unfit and consequently, the child was deemed to be in need of protection.  The application was allowed.
