YUKON TERRITORY - Territorial Court: T.L.B. (Re) [1996] Y.J. No. 145

FACTS: T.'s father submitted an application requesting the termination of a permanent custody order.  T. suffered from FAE and had special needs.  Despite his alcoholism, the father had tried to improve his life in order to obtain custody of his child. 

HELD:  The judge concluded that in light of the child's condition, a change in environment would be detrimental. The application was dismissed.
