FACTS: The Minister submitted an application requesting permanent custody of two children. The parents opposed the application, and sought temporary custody under the supervision of the Minister. The younger child was suspected to be suffering from
FAS, while a pediatrician had formally diagnosed the oldest child with FAS. A psychologist stated that the oldest child, K., required a stable environment, which the parents had failed to provide. Even though the younger child was beginning to show signs of FAS, a formal diagnosis could not be made because of the child's young age.
HELD: The judge concluded that the children's special needs rendered them vulnerable and in need of protection.
