ONTARIO - Superior Court of Justice: Children and Family Services for York Region v. M.A.G. [2002] O.J. No. 287

FACTS: The Society submitted an application for wardship without access, for the purpose of adoption.  Both biological parents opposed the application. The foster parent suspected that the biological mother had abused alcohol during pregnancy, which in turn prompted her belief that the child may suffer from FAS. Dr. Wendy S. Meschino stated that although the child was currently not showing signs of FAS, the future development of symptoms remained a possibility.

HELD: The child was determined to be in need of protection, thus the Society's application was allowed.
