ONTARIO - Superior Court of Justice: Lennox and Addington Family and Children's Services v. S.W. [2002] O.J. No. 5362

FACTS: The Children's Services submitted an application for the wardship of C.K.E.  The biological parents, who had given C. up for adoption at birth, consented.  The present guardian, S.W., opposed the application. A social worker for the Children's Services suggested that the child may suffer from Glossary Link FAS, but the opinion was not regarded as a medical opinion.  No evidence supporting a diagnosis of FAS was discovered.   It was established, however, that the mother had abused alcohol during her pregnancy.

HELD: The application was allowed, with the hopes that the child might be adopted.
