ONTARIO
Superior Court Of Justice

ONTARIO - Superior Court of Justice: A.J.W. (Re) [2001] O.J. No. 546

FACTS: The mother was appealing a previous judgment, which placed her two children, A.J.W. and A.M.W., in the custody of the Children's Aid Society.  Carol Griffith, Ph.D, assessed A.J., the oldest child.  Dr. Griffith concluded that A.J. suffered from Glossary Link FAS and was developmentally delayed.  Furthermore, Dr. Griffith stated that the child would require special care and a stable environment as a result of these severe deficits.

HELD: The appeal was dismissed because the mother had failed to demonstrate her ability to meet the needs of her children.
