NOVA SCOTIA - Family Court: Nova Scotia (Minister of Community Services) v. M.J.[1988] N.S.J. No.546

FACTS: The Minister put forth an application, seeking permanent custody of two children: R. and P.  The mother, M.J., opposed the application. P. had been formally diagnosed as suffering from Glossary Link FAS.

HELD: The judge recognized this condition as requiring special care, which the mother could not provide.  Therefore, both children were deemed to be in need of protection and the Minister's application was granted.
