NEWFOUNDLAND - Supreme Court, Unified Family Court: Newfoundland (Director of Child, Youth and Family Services, St. John's Region) v. T.L. [2001] N.J. No. 72

FACTS: The Director submitted an application for the continuous custody of two children.  The parents opposed the application. Dr. Dennis Kimberley, a clinical consultant in social work, diagnosed the children as suffering from numerous conditions, including Glossary Link FAS.  Both children were deemed to possess special needs. 

HELD: Since the children's needs had not been met in the past ¾ and the judge anticipated that the parents would not meet these needs in the future ¾ the judge granted the application.
