NEWFOUNDLAND - Supreme Court, Unified Family Court: J.B. (Re) [1996] N.J. No. 278

FACTS: The Director submitted an application requesting the custody of J.B.  The child's father opposed the application.  J.B. was removed from the care of the father following numerous complaints regarding the respondent's care of the child, as well as the child's nutritional problems.  Because the child was not thriving, the possibility of Glossary Link FAS was suggested, however several physicians stated that no symptoms of the disorder were present.

HELD: The judge concluded that the father was not a suitable parent, and that the child was in need of protection. The Director's application was allowed.
