MANITOBA - Provincial Court, Family Division : Manitoba (Director of Child and Family Services) v. K.L.M. [1993] M.J. No. 82

FACTS: The Director submitted an application requesting the permanent custody of two children.  The children's mother opposed the application. The mother stated that she suspected that her second child suffered from Glossary Link FAS, because she had consumed alcohol during her pregnancy.  However, no symptoms of FAS were discovered. 

HELD:  The mother was clearly expressing concern for her children and was attending parenting counseling.  In light of these efforts, the Director failed to demonstrate the children's need for protection.  Consequently, the application was dismissed.
