MANITOBA - Court of Queen's Bench: Winnipeg Child and Family Services v. Z.D.V. [2000] M.J. No. 77

FACTS: The Child and Family Services put forth and application requesting the permanent custody of four children.  The children's mother, Z.D.V., opposed the application and sought to regain custody of her three youngest children while the maternal aunt sought custody of the oldest child. An assessment revealed that the two oldest children suffered from Glossary Link FAS while the two youngest children were suspected of having FAS.  Dr. Laura Mills evaluated all four children and concluded that each of them required tremendous support from attentive parents, as a result of their special needs.

HELD:  The judge determined that the three youngest children were in need of protection, and therefore granted permanent custody to the agency.  Furthermore, the oldest child was placed in the care of the maternal aunt.
