BRITISH COLUMBIA - Provincial Court, Family Division: British Columbia (Director of Family and Child Services) v. A.H. [2001] B.C.J. No. 2203 BCPC 270

FACTS: The Director sought the continued custody of two children.  The maternal grandmother opposed the application. The mother admitted to abusing alcohol while she was pregnant with the younger child, S. The child was thus suspected of suffering from Glossary Link FAS, and the grandmother was deemed incapable of fulfilling the child's special needs. 

HELD: The Director's application was allowed and the grandmother was granted access.
