FACTS: The Director sought the continuing custody of two children, one of whom had been diagnosed with Glossary Link FAS.  Both parents opposed the application.  The children were initially removed from the family because their parents were irresponsible. The relationship between the two adults was toxic and involved numerous arguments, one of which ended in the arrest of the couple.  During this trial, the existence of a poor inter-parent relationship, coupled with the special needs of an FAS child, was a reason for concern.

HELD: The application was allowed and the Director was granted continuing custody.
