FACTS: The Superintendent sought the permanent custody of a child, but the child's native band opposed the application. The child was diagnosed as suffering from Glossary Link FAS at birth and therefore had always had special needs. 

HELD: The band could not meet the child's special needs.  Consequently, the Superintendent's application was granted.
