FACTS:  The Director submitted an application requesting permanent custody of C. The father opposed this application.  Dr. Thira Govender, a pediatrician, assessed C. and observed deficits that could be related to Glossary Link FAS. However, supporting evidence of the mother's alcohol consumption during gestation was insufficient.  As a result, a diagnosis could not be pronounced.

HELD: The judge deemed that the child was in need of protection and granted permanent custody to the Director.
