ALBERTA - Court of Queen's Bench: Tomas v. Tomas [2000] A.J. No. 1044

FACTS: Upon divorce, Ms. Tomas moved to Edmonton, Alberta, while Mr. Tomas remained in Brampton, Ontario.  Their child, who had behavioural problems and other deficits, was to be enrolled in school in Edmonton.  Dr. Carroll, a child psychiatrist, assessed the child.  Despite the Ms. Tomas' alcohol abuse during pregnancy, the physician concluded that the child did not suffer from Glossary Link FAS.

HELD: The child was allowed to enroll in the Edmonton school, and the father was allowed access to his child
