ALBERTA - Court of Queen's Bench: S.G. v. Alberta (Director of Child Welfare) [2002] A.J. No. 1510 ABQB 1062

FACTS:  S.G appealed a previous judgment in which custody of her child had been given to the Director.  The judge from the initial trial had concluded that S.G. was unable to care for her child because she suffered from Glossary Link FAS.  Two psychologists, Dr. Perlita Torres and Dr. U.T.A. Neumann, assessed S.G. and noted that she could not provide her child with the proper care. However, the two psychologists remarked that S.G. would be able to adequately care for her child if she was provided with qualified assistance.

HELD:  It was determined that the Director had not heeded the advice of the psychologists and that permanent guardianship should thus not have been originally conceded.  Consequently, the appeal was granted.
